The new Land Amendment Act forgives the past,
but denies the future.
പുതിയ ഭൂഭേദഗതി നിയമം: ക്രമീകരണം മാത്രം, അവകാശം അല്ല
Commercial Construction Ban Imposed
Revenue Department issues order prohibiting all commercial construction in 8 villages of Idukki district due to Land Assignment Rules violations.
6 Years of Waiting
New Land Amendment Act Introduced
✓ Regularizes existing unauthorized buildings
❌ But still no permission for new commercial construction
How Much Longer?
New construction still prohibited. Future still denied. Justice still pending.
Real people. Real dreams. Real loss.
34 years | Munnar
"I own a patta land in Munnar. I just wanted to build a small homestay on my land. But since 2019, we are not allowed to build anything commercial here. We are stuck — can't earn, can't move forward. I only wish for the right to live and survive on my own land."
Youth cannot start their entrepreneurial journey
Existing businesses cannot grow or modernize
Cannot open cafes, guest houses, or restaurants
Cannot secure children's future through business
The new law does not resolve fundamental constitutional issues
Constitution guarantees every citizen the "right to practice any profession, or to carry on any occupation, trade or business."
❌ The Issue:
New law does NOT restore this right. Ban on new commercial buildings continues in 8 villages only.
Supreme Court ruled: "Right to livelihood is an integral part of the right to life." Cannot conduct business without commercial building.
❌ The Issue:
Right to livelihood still denied. No path forward for earning through business.
All other villages in Kerala get commercial permits. Why discriminate against only these 8 villages?
❌ The Issue:
Geographic discrimination continues. Same state, same constitution, different rights.
Prof. Vijay Kumar (Constitutional Law):
"This law does not resolve the constitutional issue. Article 19(1)(g) is about the RIGHT TO BUSINESS TODAY - not just forgiving what was done before. Opening the door to the future is essential, not just pardoning the past."
Adv. Suresh Nair:
"This law is like a 'royal pardon' - it forgives past offenses. But it does NOT grant the right to do the same thing in the future. This is not rights restoration, it's one-time relief only."
If the new law passes in its current form, constitutional challenges are likely:
Past Forgiven. Future Denied.
Regularization of Old Buildings
Existing unauthorized commercial structures can be legalized
Fast Processing for Residential
24-hour certificate for residential buildings
Online Application Process
ReLIS portal for transparent processing
60-Day Decision Timeline
Time-bound process for commercial building regularization
NO New Commercial Permits
Still cannot build new shops, cafes, or businesses
NO Youth Opportunities
Young entrepreneurs still cannot start their ventures
NO Business Expansion
Existing businesses cannot grow or modernize
NO Future Vision
The door to tomorrow remains closed
"We will forgive your old mistakes (with fees). But your new dreams are still forbidden."
"Is this justice? Is regularizing the past enough? What about our future?"
Situation: Small commercial building built in 2018, unauthorized
New Law: ✓ Can be regularized (with fees)
Result: Becomes legal, can continue business
Situation: Young person wants to start a workshop in 2025
New Law: ❌ Permission denied
Result: Dream shattered, must leave village
Question: Why does Case 1 have rights but Case 2 doesn't? Same village, same type of business.
Answer: The law is forgiving to the past, cruel to the future.
Not charity. Not special favors. Just our constitutional rights.
The new Land Amendment Act must include provisions for new commercial buildings:
Critical community services must be permitted immediately:
Fair and efficient permit system:
Recognition of economic damage suffered:
These are not unreasonable requests. They are basic rights guaranteed by our Constitution. Join us in demanding complete justice, not half measures.
Temporarily lift the prohibition pending new law

What specialists say about the situation
Estimated Economic Loss Over 6 Years
Urban Planning Expert
"This is a failure of planning. The right approach: zoning laws, size restrictions, environmental standards. Not total prohibition. Balanced development is possible - we've seen it in mountainous regions like Switzerland and Austria."
Economist
"When we calculate the 6-year economic loss: Approximately 50,000 families in 8 villages. Annual loss per family ₹50,000 (small business opportunity). Total loss: Over ₹1,500 crores. Youth migration, brain drain - immeasurable loss."
Key Finding:
The economic impact extends beyond direct losses. The psychological toll, loss of entrepreneurial spirit, and community decline cannot be quantified.
Environmental Expert
"Environmental protection is necessary. But it shouldn't come at the cost of community development. The solution: Green building standards, size limitations, waste management conditions. Total prohibition cannot be scientifically justified."
